This Legal Notice regulates access, navigation and use of this website www.cavavalenciano.com (hereinafter the “Website”).

 

1. RIGHT TO INFORMATION
In compliance with the duty of information set out in Article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, we hereby inform you that the Website is the property of the ASSOCIATION OF ELABORATORS OF CAVA DE REQUENA (hereinafter, “THE ASSOCIATION”) with tax identification number G98529183, with registered office at Calle Capitán Gadea 15, 46340, Requena, Valencia, Spain (hereinafter, “THE ASSOCIATION”).

2. USERS
The access and/or use of the Web Site attributes the condition of User to you, and you accept, from said access and/or use, the present Legal Notice and, if applicable, the changes made to it.

3. USE OF THE WEBSITE BY USERS
The Website may provide access to a multitude of texts, graphics, drawings, designs, codes, software, photographs, music, videos, sounds, databases, images, expressions and information (hereinafter “Content”) belonging to THE ASSOCIATION or to third parties to which the User may have access.
The User assumes responsibility for the use of the Website. Said responsibility extends to the registration that, where appropriate, is necessary to access the Contents of the Website.
The User undertakes to make appropriate use of the Contents offered through the Web Site and, by way of illustration but not limitation, not to use them for (1) committing illicit or illegal activities or activities contrary to good faith and public order; (2) causing damage to the physical and logical systems of the owner of the Web Site, its suppliers or third parties; (3) introducing or spreading computer viruses or any other physical or logical systems that may cause the aforementioned damage.

4. INTELLECTUAL PROPERTY OF THE WEBSITE
All rights to the Content, design and source code of this Website and, in particular, but not limited to, all rights to the photographs, images, texts, logos, designs, brands, trade names, data included on the Website and any other intellectual and industrial property rights are owned by THE ASSOCIATION, or by third parties who have expressly authorised THE ASSOCIATION to use them on its Website.
Therefore, and by virtue of the provisions of Royal Legislative Decree 1/1996, of 12 April, which approves the revised text of the Intellectual Property Law, regularizing, clarifying and harmonizing the legal provisions in force on the subject, as well as in Law 17/2001, of 7 December on Trademarks and complementary legislation on intellectual and industrial property, the reproduction, transmission, adaptation, translation, distribution, public communication, including the way in which it is made available, of all or part of the Contents of the Website, on any support and by any technical means, is expressly forbidden, unless expressly authorised in writing by THE ASSOCIATION.
THE ASSOCIATION does not grant any license or authorization of use of any kind over its intellectual and industrial property rights or over any other property or right related to the Website, and in no case shall it be understood that the access and navigation of the Users implies a waiver, transmission, license or total or partial assignment of such rights by THE ASSOCIATION.
Any use of these contents not previously authorised by THE ASSOCIATION shall be considered a serious breach of the intellectual or industrial property rights and shall give rise to the legally established responsibilities.

5. RESPONSIBILITY AND GUARANTEES
THE ASSOCIATION declares that it has adopted the necessary measures that, within its possibilities and the state of technology, allow the correct functioning of its Website as well as the absence of viruses and harmful components. However, THE ASSOCIATION cannot be held responsible for: (a) the continuity and availability of the Contents; (b) the absence of errors in said Contents or the correction of any defect that may occur; (c) the absence of viruses and/or other harmful components; (d) the damages caused by any person who violates the security systems of THE ASSOCIATION.
THE ASSOCIATION may temporarily suspend, without prior notice, access to the Website for maintenance, repair, updating or improvement operations. Nevertheless, whenever circumstances allow it, THE ASSOCIATION shall inform the User, with sufficient notice, of the date foreseen for the suspension of the contents.

THE ASSOCIATION is not responsible for the use that users may make of the Contents included in the Website. Consequently, THE ASSOCIATION does not guarantee that the use that users may make of the Contents included in the Website, if any, comply with this Legal Notice, nor that they do so diligently.

6. HYPERLINKS
The Website may contain hyperlinks that allow the User to access third party websites. THE ASSOCIATION does not assume any responsibility for the content, information or services that may appear in such sites, which shall be understood to be offered exclusively for information purposes by THE ASSOCIATION, and which in no case imply any relationship, acceptance or support between THE ASSOCIATION and the persons or entities that own such content or the owners of the sites where they are located.

7. PUBLICATION OF COMMENTS AND OPINIONS ON THE WEBSITE
In the event that the Website allows users to publish comments and opinions on the Website (for example, through a Blog), users expressly declare that all the content they publish on the Website is their exclusive property, or that they have the express authorisation of the owners of the content, and users shall be exclusively responsible in the event that such content does not infringe the rights of third parties.
Users should bear in mind that such comments and opinions should not contain expressions that are not suitable for all audiences, nor should they incorporate content that is unseemly or inappropriate or offensive to general sensitivity.

In particular, the Website will not allow:

Discriminatory publications: Under no circumstances will publications be permitted that go against an individual and that violate the principles of the right to honour, personal and family privacy, one’s own image and the dignity of the person. Any type of discriminatory publication is prohibited, whether on the grounds of race, sex, religion, opinion, nationality, disability or any other personal or social circumstance.

Degrading content: Publications that are intimidating, threatening, degrading or that in any way promote violence against a person or a specific group are not permitted.

Advertising Content: It is not permitted to use the Web Site as a means of advertising, promoting business, brands or personal items, or to obtain e-mail addresses to which unsolicited commercial communications may subsequently be sent.

Content that promotes self-injurious behaviour: All types of publications that promote the consumption of narcotic substances are prohibited, as well as those publications that aim to incite eating disorders and self-injury.

THE ASSOCIATION reserves the right to eliminate any comments and opinions that may be incorporated into some of the aforementioned contents. Likewise, THE ASSOCIATION reserves the possibility of limiting the access of the user who has not complied with the provisions of this section.
Likewise, we inform you that the users who publish contents in the Website grant THE ASSOCIATION a universal, unrestricted and free license for the use, distribution, public communication, adaptation and reproduction of such contents. Through this license THE ASSOCIATION will be able to transform, adapt and, in short, use the contents for the correct operation of the Website.

8. MODIFICATIONS
The conditions of this Legal Notice will be in force until they are modified, and the ASSOCIATION may make these changes, which will be communicated to the User.
THE ASSOCIATION may delete, add or change both the Contents and the way in which they are located or presented. The conditions published at the time the user accesses the ASSOCIATION’s Website are understood to be in force.

9. APPLICABLE LEGISLATION AND JURISDICTION
These Terms and Conditions are subject to Spanish law. In case of conflict, the parties submit to the Courts and Tribunals corresponding to the domicile of THE ASSOCIATION, unless the law expressly provides for another jurisdiction.
